ABSTRACT
Social participation is one of the guidelines Brazilian health system. Health councils are collegiate instances established by Law 8.142/90. The most recent legal regulation for council organization and functioning was through Resolution 453/2021. institution has a permanent deliberative nature to act in formulation, deliberation control policy implementation, including economic financial aspects.To evaluate compliance with directives establishment, restructuring operation from Brazil, based on 453/2012.An exploratory, descriptive study that used Council Monitoring System as data source. Qualitative variables were selected identify characteristics related councils' establishment (legal instruments establishment), strategies adopted (budget allocation, existence an executive secretariat, provision dedicated office) (frequency regular meetings, board directors, election directors).The analyzed three groups constitution, councils.
