This paper intend to contribute establish certain coordinates that allow show tensions leads the demands of human rights indigenous peoples, in this case Mapuche a neoliberal economic model has not solved discriminations experienced by people their liberal sense within Chilean democratic system, and therefore order fulfill collective rights, new legal political institutions enable transformation state refused give them another site as subjects it is needed. En este texto se pretende contribuir establecer ciertas coordenadas que permitan mostrar las tensiones conllevan exigencias de los derechos humanos pueblos originarios, en caso mapuche, un modelo económico que, además, no ha resuelto tampoco discriminaciones experimentan indígenas su sentido y social dentro del mismo sistema democrático chileno, respecto cumplimiento sus colectivos, necesita nueva institucionalidad jurídica política permita transformar Estado les negado otro dé sitio como sujetos derechos.
