Regulating for trust: Can law establish trust in artificial intelligence?

ABSTRACT
Abstract The current political and regulatory discourse frequently references the term “trustworthy artificial intelligence (AI).” In Europe, attempts to ensure trustworthy AI started already with High‐Level Expert Group Ethics Guidelines for Trustworthy have now merged into on EU Act. Around globe, policymakers are actively pursuing initiatives—as US Executive Order Safe, Secure, AI, or Bletchley Declaration showcase—based premise that right strategy can shape trust in AI. To analyze validity of this premise, we propose consider broader literature automation. On basis, constructed a framework 16 factors impact automation more broadly. We interplay between these disentangle them determine regulation each. article thus provides legal scholars foundation gauge different strategies, notably by differentiating those strategies where is likely also influence (e.g., regulating types tasks may fulfill) its limited measures increase awareness complacency biases). Our analysis underscores critical role nuanced shaping human‐automation relationship offers targeted approach debate how streamline efforts future governance.
