要旨:近年,脳卒中に関連する診療ガイドラインが公開され,医療現場において利用されている.「脳卒中治療診療ガイドライン」が判決文中引用されている裁判例のうち判決文全文が入手可能で脳卒中の診療が争点となった裁判例について検討した.対象は7 事例(8 裁判例)あり,判決の理由中ガイドラインが過失判断において引用された場合,おおむねガイドライン通りの認定がなされていた.特にガイドライン中,エビデンスレベルが引用されている判決が目立った.民事訴訟はその制度的特性から必ずしも客観的な医学的妥当性は担保されていないものの,民事訴訟での医学的妥当性を必要最低限担保するためにガイドラインが寄与しうる余地がある.
